The Section 377 of the Indian Penal Code as far as it criminalizes gay sex among consenting adults is violation of fundamental rights, the high court said. The Delhi High Court today (2nd July 2009) has legalized homosexuality in India by striking down section 377 of the Indian Penal Code (IPC) which criminalizes homosexuality.

Earlier, the UPA government was in favor of scrapping Section 377 with Law Minister Veerappa Moily calling the law outdated. But later the Center backtracked with both Moily and Health Minister Ghulam Nabi Azad calling for consensus.
